Why the calculators fail here more than anywhere

Online calculators multiply medical bills or apply a daily rate. In a wrongful death case the medical bills may be small, if death was quick, or enormous, if it followed prolonged care, and neither reflects the loss the family suffered.

The loss in a death case is the value of a relationship and of financial support that will never arrive. There is no bill for that, and no multiplier that a Texas court applies to it.

What Texas actually compensates

The wrongful death claim compensates the surviving spouse, children and parents for their own losses: lost financial support and services, lost inheritance, and the loss of love, companionship, comfort and guidance the person provided.

The survival claim, brought by the estate, adds what the person could have claimed themselves: conscious pain and suffering before death, medical costs and funeral expenses. These are separate and are valued separately.

The factors that actually move the figure

The deceased's age, health and life expectancy. Their earnings and the financial support they provided. The number and ages of dependents. The closeness of the relationships, which sounds uncomfortable but is a real element of loss of companionship.

What can honestly be given early is a range and the factors that would move you within it, which is genuinely useful where a false precision is not.

Where the death resulted from gross negligence, exemplary damages may be available on clear and convincing evidence, subject to statutory caps. Drunk driving and certain corporate conduct are the common contexts.
