You claim against the at-fault driver first
Where another motorist caused the collision, the claim runs against their liability policy in the ordinary way, whatever the app was doing.
Texas minimum limits are 30,000 dollars per injured person. For a driver facing both injury and loss of the vehicle they earn with, that is frequently exhausted quickly.
Uninsured and underinsured motorist coverage, which period decides
Where the at-fault driver has no insurance or too little, UM and UIM coverage matters more to rideshare drivers than to almost anyone, because they are exposed to other road users for many more hours.
During a trip, the platform's policy generally includes UM and UIM. While merely available with the app on, coverage is more limited. With the app off, only the driver's own policy responds, and many personal policies exclude commercial use.
The personal policy exclusion problem
Standard personal auto policies commonly exclude use of the vehicle for hire. A driver who has not added a rideshare endorsement may find their own insurer declines a claim that arose while driving for the platform.
This is worth checking before it matters. The gap is real and it surprises drivers who assumed the platform's cover replaced their own rather than sitting alongside it.
Lost income is harder to prove and more important
A rideshare driver has no sick pay, and the vehicle is the tool of the trade. Loss of use of the car is itself a recoverable loss while it is repaired or replaced.
Income proof takes work: platform earnings statements, weekly summaries, tax returns and bank records. Download the earnings history early, because access to historical statements is not guaranteed indefinitely.
Being a contractor does not reduce the claim
Independent contractor status affects benefits, not the right to recover from someone whose negligence injured you. Full damages are available: medical costs, lost earnings, lost earning capacity, pain, impairment and disfigurement.
Where the driver was working and someone else was at fault, there is no workers compensation route in the ordinary case, which makes the negligence claim the whole of the recovery.
