Two years, from the explosion
Section 16.003 of the Texas Civil Practice and Remedies Code gives two years from the date of injury to file suit. Wrongful death claims run two years from the date of death, which after a period in a burn unit is often a different date.
Filing means commencing a lawsuit. Notifying a utility, speaking to an insurer or participating in an investigation does not preserve the deadline.
Claims against a municipal utility are much shorter
Many Texas gas distribution systems are municipally owned. Where a governmental unit is responsible, the Texas Tort Claims Act requires formal written notice within six months, and city charters frequently impose shorter periods.
Whether the operator is a private utility or a municipal one is not always obvious from a bill, and it changes the deadline by more than a year. It needs establishing immediately.
The scene is cleared within days
This is the deadline that actually decides explosion cases. The site is made safe, debris is removed, the damaged pipe or appliance is taken away, and the ground is excavated and backfilled.
The failed component is the case. A corroded service line, a defective regulator, a flexible connector that failed, or an appliance with a known defect cannot be examined once it has gone. Preservation demands need to go out immediately, to the utility, the contractor and any investigating body.
Evidence held by others that is not kept indefinitely
Odor complaint logs, leak survey records, cathodic protection readings, pipeline integrity management data, work orders and 811 locate tickets all sit with utilities and contractors, and retention periods vary.
Fire marshal and Railroad Commission investigation materials may be available, but access takes time to arrange and the underlying physical evidence may be released before that happens.
Where the period is extended
A claimant who was a minor generally has until two years after turning eighteen, and legal incapacity can toll the period. A person in an induced coma or undergoing prolonged critical care may fall into the latter, though it is argued on specific facts.
None of these should be relied on. The extension exists for cases where nothing else was possible, not as a reason to wait.
Product claims have their own limits
Where a defective appliance, connector or regulator caused the explosion, a product claim may be subject to a statute of repose in addition to the limitations period, which can bar claims a fixed number of years after the product was sold regardless of when the injury occurred.
This is another reason the age and origin of the failed component matter, and another reason to preserve it.
